Appeals board communicating today with the judge

The Oconee Board of Zoning Appeals has reaffirmed an earlier decision to grant an exception that will allow Dollar General to build on the Ebenezer Road.  And according to Greg Gordos, county planner, a written communication is being sent today to Judge Lawton McIntosh, along with a rationale of why the board took the action.  The board’s decision is being challenged in court by nearby homeowners, and McIntosh requested additional information before he rules on the appeal.  Gordos told 101.7/WGOG NEWS this afternoon that McIntosh wants to ensure the board did not act arbitrarily and capriciously when, within a few months, rejected one Dollar General on Ebenezer Road and then approved a second one nearby.
