Kmart told to hold the video

An Oconee Common Pleas judge today ordered Kmart to preserve and safeguard any and all video recordings of an alleged recent incident at one of its stores. Judge Alex Macaulay, acting on a motion by attorney Paul Cain, ordered that the retail store ensure that the tapes are not erased or destroyed, as Cain pursues a case in which the lawyers says his client, Carolyn Botones, was hurt when she fell over a store display. At a hearing in the Common Pleas Court, Cain told Macaulay that Kmart maintained multiple video cameras where his client fell. Kmart was not represented at the hearing, and the judge set a further hearing for October 19.
