Moulder: appeal still possible

As late as today, Oconee County had filed no appeal of last month’s loss of zoning challenge. And it appears the county’s decision whether to appeal will come down to the final days of the period for which the appeal is possible. The case involves the summary judgment won last month by David McMahan, Jean Jennings, and other plaintiffs in their challenge of agricultural residential district zoning. Scott Moulder, Oconee County administrator, said this afternoon, “We have not received the advice from our attorneys at this point. It was scheduled for last night.” But Moulder said the death of Councilman Archie Barron has delayed that legal advice. The cutoff date for an appeal, 96.3/WGOG NEWS has learned, is early next week.
