OGS trial begins

Trial opens at 10 this morning in Walhalla in the State’s case against Dan Lavert Temple. The 41-year old Temple faces two drug charges: possession of a controlled substance second degree and possession with intent to distribute crack cocaine third offense. In pre-trial motions yesterday, the defense failed to convince the judge to suppress a search warrant used last summer to search a Seneca motel room. Judge Alex Macaulay also ruled that the prosecution may introduce a signed and initialed waiver of rights form though, from the witness stand yesterday without the jury present, Temple insisted he neither signed the form, nor initialed it. Macaulay said the issues raised during the pre-trial motions are matters for the jury to weigh.
