Prisoner’s request called “frivolous”

State prisoner Dan Temple Jr. says his due date to be released is September 1, and when he is freed he wants protection from law enforcement. But, after hearing Temple’s plea yesterday, Oconee Common Pleas Judge Lawton McIntosh denied the prisoner’s request for a restraining order against the Oconee Sheriff’s Office. McIntosh termed Temple’s request frivolous and told him he had made an “absolutely zero showing.” Temple said he understood that law enforcement had the right to approach him if it had just cause as part of a criminal investigation. Temple said he wanted a restraining order to protect him from the Sheriff’s Office, such as an order that protects a woman from an abusive husband. But, in this, McIntosh said the comparison had no relevance. State Department of Corrections records show Temple is 64 years old and has been serving a term for drug violations since 1998. After yesterday’s hearing Temple, in prison attire and shackles, was escorted back to prison.
