Seneca mud runs a potential for personal injury liability

In a litigious environment, Seneca-sponsored mud runs are apt to become something of the past.  Mud runs test the runner’s physical endurance and, in the case of Seneca, have been staged as fundraisers for organizations, such as the Collins Children’s Home.  But the mayor and council are considering the city administrator’s recommendation that, because of the potential for personal injury liability, the city should no longer sponsor them.  Councilwoman Denise Rozman asked whether a waiver signed by the runners protects the city.  But she was told by Michael Smith, the city attorney, the waiver doesn’t protect the city if a court determines someone was liable for an accident.  At its December meeting, the council is likely to vote whether to stop city-sponsored mud runs.  In the meantime, Mayor Dan Alexander has asked that the city consider alternate uses for the mud run course, located behind the Shaver Recreation Complex.
