Survival action filed over pedestrian’s death

Ten days following a pedestrian’s death in Oakway, the daughter of the deceased has filed a damage lawsuit against the car driver. Sandra Faye Dickson died at night after being struck by an SUV as she was walking across South Carolina 24. At the time, Coroner Karl Addis said, Dickson was headed home after having emptied the mailbox on the opposite side of the two-lane highway. A lawsuit was filed Tuesday in the Oconee Common Pleas Court on behalf of Tonya Mathis, representing her mother’s estate. The lawsuit names Joshua Allen Cox the defendant and identifies him as the driver of the vehicle involved. It alleges Cox’s vehicle was traveling “at a rate of speed which was excessive for the circumstances and failing to keep a proper lookout.” The lawsuit seeks actual and punitive damages of an unspecified amount and seeks a jury trial in the Common Pleas Court.
