Wrongful death claim filed

A claim alleging wrongful death has been filed in OconeeCounty for an Asheville, North Carolina area woman who is the personal representative of the estate of Joshua Adam Silvers.  The 29-year old Silvers and a second person, 28-year old Michele Wright, were killed in a traffic accident the night of September 6, 2014 near Seneca.  Silvers and Wright were in a Mazda. The lawsuit, for Kimberly Silvers in the Common Pleas Court, alleges that a Chevy truck driven by Drew Woodall Greene was headed east on 76/123 at a high rate of speed when the truck struck the Mazda and, before coming to a stop, hit another vehicle.  According to the court filing, Kimberly Silvers is the ex-wife of Joshua Adam Silvers and has been appointed the personal representative of the estate.  The accident occurred on a Saturday night at 123 and the Sheep Farm Road.  A jury trial is requested to determine actual and punitive damages.  The highway patrol charged Greene with felony driving under the influence resulting in death.  But the charges were later dismissed when the solicitor’s office determined that prosecution was not supported by law.  According to an announcement three months later by the office of Solicitor Chrissy Adams, tests showed Greene’s blood alcohol level was 0.0 and no drugs in his system.  It also said that hospital records showed Greene suffered from a condition marked by a dangerous increase of lactic acid levels in the bloodstream.  “The levels of lactic acid present in Mr. Greene’s body were such that disorientation, confusion, loss of consciousness, and seizures would likely result.”
