Developer dismissed as defendant in civil case

One of the defendants in a civil lawsuit alleging negligence at an apartment complex near Clemson University has been dismissed from the case.  An order signed this week by 10th Circuit Judge Scott Sprouse dismisses realtor/developer Tom Winkopp as one of four defendants named in a suit filed for Theodore Padussis, a Maryland resident, who lived at the High Pointe apartment complex while enrolled as a student in the Bridge program.  Three other parties are listed as the remaining defendants:  High Pointe, LLC; Clemson University; and Tri-County Technical College.  Sprouse’s order, signed Monday, reads, in part, “Defendants have failed to respond to Plaintiff’s complaint for damages.  It has come to the attention of Plaintiff’s counsel that the originally named Defendant, Tom Winkopp, Realtor/Developer, LLC was incorrectly identified as a Defendant….The Plaintiff wishes to dismiss the Complaint for Damages against Defendant Tom Winkopp….”  The lawsuit for Padussis alleges negligence over living arrangements.
