Motion hearing next month

Attorneys representing Oconee County are scheduled next month to ask a circuit judge to throw out a lawsuit that attacks the agricultural residential classification provision in the county’s zoning enabling law. According to a court officer, a motion to dismiss or grant summary judgment is to be heard at noon Monday, July 29 in Common Pleas Court at Walhalla. The request for a declaratory judgment was filed last summer for David McMahan, Jean Jennings and other plaintiffs.
