No formal order, yet

96.3/WGOG NEWS learned this week that a formal written order to settle an Oconee County zoning dispute has yet to be submitted for the signature of the presiding judge. Once it’s signed by Judge Lawton McIntosh, the case of Jennings, McMahan and others against Oconee County will be final—unless there’s an appeal. McIntosh ruled late last month in favor of the plaintiffs. But it’s the formal order from which Oconee County, if it so chooses, may appeal to the South Carolina Court of Appeals in Columbia. The order, once it is submitted and signed, is expected to spell out the plaintiffs’ arguments against the county’s agricultural residential zoning classification as a violation of the South Carolina Right to Farm Act.
