Prosecution rests, trial turns to defense

A trial at Walhalla resumes at 1:30 this afternoon, and the defense will get a chance in front of the jury. Joshua Toney, early 30s in age, is standing trial on charges of burglary second degree and theft of controlled substance—having been arrested in 2011 within one month of a burglary at the Drive-Thru of America pharmacy at Seneca. The drug store is no longer in business. A video surveillance tape of the crime scene indicated the burglary was perpetrated by two individuals who used a large rock to smash the drive-thru window. As many as an estimated two thousand pills were stolen.
