Toney trial postponed

The trial judge and the defense attorney in South Carolina versus Joshua David Toney have disqualified themselves in the case of South Carolina against the defendant. For the 31-year old Toney, it means he’ll have to find a new lawyer to defend him in the Oconee County General Sessions Court. And it means that a judge, other than Alex Macaulay, will have to agree to hear the case. As attorneys 30 years ago, b0th DannyDay and Macaulay provided legal representation to the victims in the current case and it’s felt that, to avoid the appearance of a conflict, they had better disassociate from the pending case. Toney was arrested in 2011 and charged with burglary second degree and theft of a controlled substance from the Drive-Thru Pharmacy near Seneca, a drug store that has since closed.
