Wrongful death claim settled by judge’s order

 

A claim alleging wrongful death near Seneca nearly two years ago was settled today in an Oconee courtroom.  Common Pleas Judge Scott Sprouse approved an order submitted by attorneys that puts an end to the damage lawsuit filed by Kimberly Silvers against Drew Woodall Greene.  The agreement disburses $25 thousand dollars from the state’s uninsured motorist fund for two surviving children of Kimberly Silvers and the late Joshua Adam Silvers.  Mr. Silvers and Michelle Wright were killed in a September 2014 accident at the intersection of U-S 123 and the Sheep Farm Road.  Kimberly Silvers is the personal representative of Mr. Silvers estate and the mother of the deceased children.  The two persons who died were in a car that was hit by a truck driven by Drew Woodall Greene.  The highway patrol charged Greene with driving under the influence resulting in death. But the charges were  dismissed when the Solicitor’s office determined that no drugs were in Greene’s system and tests showed his blood alcohol level was 0.0.  According to the 10th Circuit Solicitor’s office, hospital records showed Greene suffered from a condition that likely could lead to “disorientation, confusion, loss of consciousness, and seizures.”  In answer to Judge Sprouse questions, the plaintiff said she believed the settlement was fair.
